Prohibited Conduct

Account Registration and Security

- You agree not to impersonate others or use offensive or infringing usernames.
- Credentials & Security: You are entirely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach.
- AProhibited Conduct: You may not share your account credentials, sell your account, impersonate others, or use offensive, inappropriate, or infringing usernames.
- Fair Play & Anti-Cheating: To protect our community, ranking systems, and rewards, cheating is strictly prohibited. You agree not to use chess engines, bots, assistance software, or any external tactical calculators during gameplay. Additionally, manipulating system operations, badges, or awards—including multi-accounting to boost points—is forbidden.
- Account Changes & Deletion: You can update your profile info directly through your account settings. To request permanent account deletion, you can also use your account dashboard or contact our support team.
- Enforcement & Penalties: Any violation of these terms will result in an immediate, permanent account ban, forfeiture of all points or awards, and potential additional penalties. We reserve the right to pursue legal action if cheating, hacking, or data manipulation causes financial, operational, or reputational damage to our platform.
Ownership of Content
All proprietary material on Chess 1475 - including our website software, source code, graphics, branding, text, design layouts, and aggregated game content - is owned solely by or licensed to Chess 1475. Except for the limited right to use our services as permitted under these terms, you do not acquire any ownership rights or intellectual property rights in our platform or its contents.
Governing Law and Dispute Resolution
These Terms of Service, including all integrated legal policies, shall be governed by, and construed exclusively in accordance with, the laws of Zimbabwe. Any and all legal disputes, claims, or lawsuits arising out of or relating to these Terms, your use of the platform, or any issues involving Chess 1475 shall be brought strictly and exclusively in the courts located in Harare, Zimbabwe. You hereby irrevocably consent and submit to the personal and exclusive jurisdiction and physical venue of such courts for the resolution of any such dispute.
User Content and Conduct
- Ownership & License: By uploading content, you grant Chess 1475 a worldwide, perpetual, royalty-free, and non-exclusive license to host, store, use, and display that content for legitimate operational purposes.
- User Responsibility: You are solely responsible for your own content and assume all risks associated with its accuracy or legality.
- Content Standards: You must not upload, post, or share any material that is illegal, offensive, defamatory, or infringing on any trademark or other third-party intellectual property rights.
- Absolute Moderation Rights: We reserve the absolute and sole discretion to determine whether any user content violates our community standards or intellectual property of any kind. Our decisions are final, and we reserve the right to remove, edit, or restrict access to any content at any time, without prior notice or liability to you.
- Username Ownership: We reserve the right to reclaim, change, or remove any username at our sole discretion, without liability to you, if the username is deemed offensive, misleading, trademarked, or otherwise inappropriate.
Liability and Disclaimers
- "As-Is" and "As-Available" Services: Our platform and services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. We do not guarantee continuous, secure, uninterrupted, or error-free operation of the website or apps.
- Limitation of Liability: To the maximum extent permitted by applicable law, Chess 1475 and its team shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages.
- Scope of Exclusions: This total exclusion of liability includes, but is not limited to, any damages, losses, or expenses resulting from your use or inability to use the platform, service interruptions, server downtime, hacking, data loss, or the forfeiture or wiping of points, badges, awards, and rewards—even if we have been advised of the possibility of such damages.
- Maximum Cap on Damages: In any event, the total, aggregate liability of Chess 1475 for any claims arising out of or relating to these terms or your use of the platform shall be strictly limited to the actual, direct, and documented proven harm suffered by the user, and shall in no case exceed the total amount of money paid by the user to Chess 1475 during the twelve (12) months immediately preceding the event giving rise to the claim, or $50 USD, whichever is greater.
Intellectual Property Rights
- Platform Ownership: All proprietary material on Chess 1475—including our website software, source code, graphics, branding, text, design layouts, logos, trademarks, and aggregated game records - is owned solely by or licensed to Chess 1475.
- No Unauthorized Use: No rights or licenses to use our intellectual property are granted to you under these Terms without our express prior written consent. You agree not to copy, modify, distribute, or reverse-engineer any portion of our site or proprietary systems.
- Limited User License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable right to access and use our platform for personal, non-commercial chess play. You do not acquire any ownership rights or claims to any platform data, assets, or systems.
Linking and External Content
- Third-Party Services & Links: Our platform utilizes, integrates, and links to third-party services, vendors, and external websites—including but not limited to payment gateways, server infrastructure hosts, and gift card processors.
- No Endorsement or Liability: These external links and outsourced services are provided solely for your convenience. Chess 1475 does not control, endorse, monitor, or assume any responsibility or liability for third-party content, privacy practices, system uptime, transaction errors, or any operational failures of these external services.
- User Risk: You explicitly acknowledge and agree that your interactions, transactions, or reliance on any third-party service provider or external link are entirely at your own risk and subject solely to the terms and policies of those respective third parties.
Privacy and Data Protection
- Privacy Policy Integration: Your privacy is important to us. We collect, process, and handle your personal data in accordance with our separate Privacy Policy, which is fully incorporated into these Terms.
- Data Security & Breach Disclaimer: While we implement security measures to protect your information, no method of transmission over the internet or electronic storage is completely secure. To the maximum extent permitted by law, Chess 1475 shall not be held liable or responsible for any unauthorized access, hacking, data breaches, or leaks resulting in the loss, exposure, or modification of your data.
- Operational Data Retention: You explicitly acknowledge and agree that certain data—including game records, account details, and transaction histories—may be retained, stored, or processed on our servers or outsourced third-party servers for legitimate operational, security, and legal purposes.
Termination and Closing Accounts
- Voluntary Closure: You may close your account at any time directly through your dashboard settings or by contacting our support team.
- Immediate Forfeiture of Assets: Upon closure or termination of your account—whether by you or by us—all accumulated points, rewards, badges, rankings, and custom profile content are immediately and permanently forfeited.
- Data Post-Deletion: Following account closure, your active profile data will be removed from active view, though certain historical game records and transactional data may remain stored on our servers for legitimate operational, security, and legal purposes as outlined in our policies and at our sole discretion.
Our Rights and Regulatory Compliance
- Right to Refuse Service: We reserve the absolute right to refuse service, deny platform access, or cancel accounts for any individual at our sole discretion, without liability or obligation to provide a reason.
- Law Enforcement Cooperation: We reserve the right to cooperate fully with law enforcement, government officials, or regulatory authorities if required by law, subpoena, or court order.
- Emergency Disclosure: We may disclose your account data, traffic history, IP addresses, or communication logs to relevant authorities at our sole discretion if we believe it is necessary to investigate, prevent, or take action regarding suspected illegal activities, fraud, cheating, or threats to physical safety.
Corporate and Associate Liability
- Third-Party and Corporate Liability: If you access or use Chess 1475 on behalf of a company, employer, association, or any third-party contact, both you individually and that associated entity are jointly and severally bound by these Terms.
- Extraterritorial Jurisdiction: You explicitly agree that Chess 1475 reserves the right to initiate civil litigation, seek emergency injunctions, and pursue full legal remedies against you, your associated companies, and your contacts solely and exclusively within the physical courts located in Harare, Zimbabwe. You and your associated entities waive any objections to global service of process issued out of Zimbabwean courts.
Final Provisions
- Governing Law & Jurisdiction: These Terms of Service, along with all integrated legal policies, shall be governed by, construed, and enforced exclusively in accordance with the laws of Zimbabwe, with the physical venue for all disputes strictly restricted to the courts located in Harare, Zimbabwe.
- Severability: If any provision or bullet point within these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that specific part shall be modified or removed to the minimum extent necessary. The remaining sections of these Terms shall remain 100% valid, binding, and in full effect.
- Entire Agreement: These Terms constitute the entire, complete, and exclusive agreement between you and Chess 1475 regarding the platform. They completely supersede and replace any prior written or verbal agreements, promises, emails, or understandings.
